Commercial Drivers - CDL Traffic Ticket Offenses

Commercial drivers are held to a higher standard than regular Class E drivers due to the extensive knowledge, experience, skills, and physical abilities that are required to safely operate a commercial vehicle. As a result, Federal regulations and Florida law strictly regulate the driving privilege of CDL holders. Under Florida Statute 322.61, the accumulation of convictions for "serious traffic offenses," such as speeding, careless driving, following too closely, etc., may result in the disqualification of your commercial driver license for a period of 60 days, 120 days, or in some cases, a permanent disqualification (for offenses such as DUI). If you earn your living through commercial driving, then you understand the importance of maintaining a valid CDL.

The State of Florida considers the following offenses to be "serious traffic offenses" when committed by a CDL holder, regardless of whether you are driving a commercial or personal vehicle:

▪ Traffic offense resulting in death or personal injury to any person;
▪ Reckless driving
▪ Careless driving
▪ Fleeing or attempting to elude a law enforcement officer
▪ Unlawful speed of 15 miles per hour or more above the posted speed limit;
▪ Driving a commercial motor vehicle without insurance
▪ Improper lane change
▪ Following too closely
▪ DUI - Whether in Personal or Commercial Vehicle
▪ Driving a commercial vehicle without obtaining a commercial driver’s license;
▪ Driving a commercial vehicle without the proper class of commercial driver’s license
▪ Driving a commercial vehicle without a commercial driver’s license in possession,

Protect Your CDL - Contact Us Today
If you have received a moving-violation citation and you hold a valid Florida CDL, you may have discovered that you are not eligible to elect driving school to avoid a conviction (adjudication). Whenever you are convicted of a moving-violation, points are assessed to your driving record. A moving violation conviction could result in loss of employment, insurance increases, and a temporary or permanent disqualification of your commercial driving privilege.

We understand that your livelihood depends on your CDL and that you need to protect your driving privilege. If you have received a moving violation or a criminal traffic charge (DUI, Reckless Driving, Suspended License), your commercial driving privilege is at risk. You should never just pay your Tampa traffic ticket without consulting with an attorney. Contact us today for a free consultation.
